INTRODUCTORY PROVISIONS<\/h2>\n<ol>\n<li>These general <strong>terms and conditions<\/strong> of sale of goods by sole trader Kostiantyn Orda, registered at: Limuzsk\u00e1 2110\/8, 100 00, Prague 10 \u2013 Stra\u0161nice, Company ID: 22085718, registered in the Commercial Register in Prague, phone: +(48) 575 357 389, contact e-mail address: <a href=\"mailto:xiaomoxuan.cz@gmail.com\">xiaomoxuan.cz@gmail.com<\/a>, govern the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement (hereinafter \u2013 &#8220;<strong>purchase agreement<\/strong>&#8220;), concluded between the Seller and another individual (hereinafter \u2013 &#8220;<strong>Customer<\/strong>&#8220;). These conditions apply to contracts concluded through the online store xiaomoxuan.cz, located at <a href=\"https:\/\/xiaomoxuan.cz\">https:\/\/xiaomoxuan.cz<\/a> for customers from the Czech Republic and <a href=\"https:\/\/xiaomoxuan.com.pl\">https:\/\/xiaomoxuan.com.pl<\/a> for customers from Poland, where Customers may purchase the Company&#8217;s Goods\/Products through the web interface (hereinafter \u2013 &#8220;<strong>web interface<\/strong>&#8220;).<\/li>\n<li>Goods\/Products are movable items supplied by the Company to Customers.<\/li>\n<li>For the purposes of these General Terms and Conditions, a Customer is the recipient of Goods\/Products received from the Company for monetary consideration. These General Terms and Conditions apply exclusively to consumers as defined in \u00a7 419 of the Civil Code, i.e. any person who enters into a contract with the Company or otherwise interacts with it outside the scope of their business activity or independent professional practice. These General Terms and Conditions do not apply in cases where the person intending to purchase Goods\/Products from the Company is a legal entity or a person acting within the scope of their business activity or independent professional practice when ordering Goods\/Products.<\/li>\n<li>Deviations from the General Terms and Conditions may be agreed upon in an individual purchase agreement. Deviating provisions in the purchase agreement take precedence over the provisions of these General Terms and Conditions.<\/li>\n<li>The provisions of these General Terms and Conditions form an integral part of the purchase agreement in accordance with \u00a7 1751, paragraph 1 of the Civil Code. The purchase agreement and the General Terms and Conditions are drawn up in the Czech language. The purchase agreement may be concluded in the Czech language.<\/li>\n<li>The text of the General Terms and Conditions may be amended or supplemented by the Company. This provision does not affect the rights and obligations arising during the validity of the previous version of the General Terms and Conditions.<\/li>\n<\/ol>\n<h2>II. USER ACCOUNT<\/h2>\n<ol>\n<li>Based on registration on the website of the online store operated by the Company, the Customer may access their user interface. Through their user interface, the Customer may order Goods\/Products (hereinafter \u2013 &#8220;<em>user account<\/em>&#8220;). The Customer may also order Goods\/Products without registration directly from the web interface of the store.<\/li>\n<li>When registering in the Company&#8217;s online store and when ordering Goods\/Products and\/or Services, the Customer is obliged to provide accurate and truthful information. The Customer is obliged to update the information provided in the user account in the event of any changes. Information provided by the Customer in the user account and when ordering Goods\/Products is considered correct by the Company.<\/li>\n<li>Access to the user account is protected by a username and password. The Customer is obliged to maintain confidentiality regarding the information required to access their user account. The Customer is not entitled to allow third parties to use the user account.<\/li>\n<li>The Customer acknowledges that the user account may not be available continuously, in particular due to necessary maintenance of the Company&#8217;s hardware and software or necessary maintenance of the hardware and software of third parties.<\/li>\n<\/ol>\n<h2>III. CONCLUSION OF THE PURCHASE AGREEMENT<\/h2>\n<ol>\n<li>The web interface of the store contains information about the Goods\/Products, including their prices. Prices are stated inclusive of value added tax and all related charges. They remain valid for as long as they are displayed on the web interface of the store. The stated prices include all discounts and bonuses and are final. This provision does not limit the Company&#8217;s ability to enter into a purchase agreement with the Customer on individually agreed terms.<\/li>\n<li>The web interface of the store also contains information about costs associated with the packaging and delivery of Goods\/Products. Information about costs associated with the packaging and delivery of Goods\/Products provided on the web interface of the store applies only in cases where delivery of Goods\/Products is carried out within the territory of the Czech Republic, Poland and the EU.<\/li>\n<li>To order Goods\/Products, the Customer completes an order form on the web interface of the store. The order form primarily contains information about:\n<ul>\n<li>ordered Goods\/Products (ordered goods are &#8220;placed&#8221; by the Customer into the electronic shopping cart of the web interface of the store),<\/li>\n<li>the method of payment of the purchase price, details of the requested method of delivery of the ordered Goods\/Products,<\/li>\n<li>costs associated with the delivery of Goods\/Products (hereinafter collectively \u2013 &#8220;order&#8221;).<\/li>\n<\/ul>\n<\/li>\n<li>Before submitting the order to the Company, the Customer has the opportunity to check and change the information entered in the order, including the ability to detect and correct errors made when entering data. The order is sent by the Customer to the Company by clicking the &#8220;Complete Order&#8221; button. Information provided in the order is considered correct by the Company. Immediately upon receipt of the order, the Company will confirm its receipt to the Customer by e-mail to the Customer&#8217;s e-mail address specified in the user interface or in the order (hereinafter \u2013 &#8220;Customer&#8217;s e-mail address&#8221;).<\/li>\n<li>The Company is always entitled, depending on the nature of the order (quantity of Goods\/Products, purchase price amount, estimated delivery costs), to request additional confirmation of the order from the Customer (for example, in writing or by telephone).<\/li>\n<li>The contractual relationship between the Company and the Customer arises upon delivery of the order acceptance, which is sent by the Company to the Customer by e-mail to the Customer&#8217;s e-mail address.<\/li>\n<\/ol>\n<h2>IV. PRICE OF GOODS AND PAYMENT CONDITIONS<\/h2>\n<ol>\n<li>\n<p>The Customer may pay the price of Goods\/Products and any costs associated with the delivery of Goods\/Products under the purchase agreement to the Company in the following ways:<\/p>\n<ul>\n<li>by bank transfer (in advance) to the Company&#8217;s account: Czech Republic: 8706375003\/5500 at Raiffeisenbank a.s, CZ3755000000008706375003, SWIFT: RZBCCZPP,<\/li>\n<li>by cashless card payment (in advance) with delivery to the Customer&#8217;s address,<\/li>\n<li>by Apple Pay \u2013 payment by card stored in Apple Pay Wallet, free of charge,<\/li>\n<li>by Google Pay \u2013 payment by card stored in Google Wallet, free of charge.<\/li>\n<\/ul>\n<p>All online payments on our website are processed through Stripe \u2013 one of the most reliable payment gateways in the world. Stripe is certified according to international security standards:<\/p>\n<ul>\n<li>PCI DSS Level 1 \u2013 the highest level of payment card protection;<\/li>\n<li>ISO 27001, ISO 27018, SOC 2 \u2013 international cybersecurity standards;<\/li>\n<li>GDPR compliant \u2013 confidentiality and secure storage of personal data;<\/li>\n<li>\ud83d\udcb3 Your data is encrypted and all transactions are fully protected.<\/li>\n<\/ul>\n<h3>Certified According to International Standards<\/h3>\n<h4>Stripe meets the requirements of:<\/h4>\n<ul>\n<li>ISO 27001, ISO 27018 \u2013 protection of information and personal data;<\/li>\n<li>SOC 2, SOC 3 \u2013 independent reliability and security audit;<\/li>\n<li>GDPR \u2013 compliance with the European data protection regulation.<\/li>\n<\/ul>\n<h4>Maximum User Protection<\/h4>\n<ul>\n<li>All transactions are encrypted (SSL 256-bit);<\/li>\n<li>Card details are not stored on the website;<\/li>\n<li>Payments are processed directly on Stripe&#8217;s servers.<\/li>\n<\/ul>\n<h4>Why This Matters<\/h4>\n<p><strong>Stripe<\/strong> is the official partner of thousands of brands worldwide, including Amazon, Booking, Zoom and Shopify. This guarantees that every payment you make is processed according to the highest international security protocols.<\/p>\n<p>Bank cards are the most popular payment method among our customers. Payment is made online \u2014 it is the simplest and most modern way to pay.<\/p>\n<p>To pay by bank card, you will be redirected to a secure payment page that meets the latest international security requirements of the Visa and MasterCard payment systems.<\/p>\n<p>During the payment process, enter your card number, expiry date, the CVV code shown on the back of the card, as well as the cardholder&#8217;s name and contact details.<\/p>\n<p>Make sure the details you have entered are correct, then click the &#8220;Pay&#8221; button.<\/p>\n<p>If your bank card supports 3DSecure technology, you will be automatically redirected to your bank&#8217;s website, where you will be asked to enter the activation code sent to your phone.<\/p>\n<p>If the card details are correct and there are sufficient funds in the account, you will see a payment confirmation. You will then be redirected back to the store.<\/p>\n<p>Our online store accepts bank cards of all types and in any currency.<\/p>\n<\/li>\n<li>In addition to the purchase price, the Customer is also obliged to pay the Company the costs associated with the packaging and delivery of Goods\/Products in the agreed amount. Unless stated otherwise, the costs associated with the delivery of Goods\/Products are included in the purchase price.<\/li>\n<li>Any discounts on the price of Goods\/Products granted by the Company to the Customer may not be combined, except for discounts relating to Goods\/Products approaching their expiry date.<\/li>\n<li>Where customary in business relations or required by generally binding legal regulations, the Company shall issue the Customer with a tax document \u2013 invoice for payments made under the purchase agreement. The tax document \u2013 invoice is issued to the Customer after payment of the price of the Goods\/Products. The Customer will be notified of the issuance of the invoice by e-mail.<\/li>\n<\/ol>\n<h2>V. WITHDRAWAL FROM THE PURCHASE AGREEMENT AND RETURN OF GOODS PURCHASED REMOTELY (ONLINE STORE SALES ONLY)<\/h2>\n<ol>\n<li>The Customer has the right to withdraw from the purchase agreement in cases provided for by Act No. 89\/2012 Coll., the Civil Code, as amended, in particular in accordance with \u00a7 1829 thereof, within 14 days from the date of receipt of the Goods\/Products by the Customer or a third party designated by them.<\/li>\n<li>To exercise the right to withdraw from the agreement, the Customer must notify the Company of their decision to withdraw in the form of a unilateral legal act (for example, by a letter sent via a postal service operator or by e-mail). The Customer is not obliged to state a reason for the withdrawal.<\/li>\n<li>To meet the withdrawal deadline, it is sufficient to send the withdrawal notice to the party responsible for its delivery (postal service operator) on the last day of the period, or to send it by e-mail to <a href=\"mailto:xiaomoxuan.cz@gmail.com\">xiaomoxuan.cz@gmail.com<\/a>.<\/li>\n<\/ol>\n<h2>VI. PAYMENT CONDITIONS FOR RETURNS<\/h2>\n<p>Not satisfied with the goods you received and want to return them within 14 days? Are they damaged? Or would you like to exchange them for something else?<\/p>\n<ol>\n<li>If the Customer withdraws from the agreement in accordance with this clause of the complaints policy, the Company will refund, without undue delay and no later than 14 days from the date of receipt of the Customer&#8217;s withdrawal notice, all payments received from the Customer in connection with the Goods\/Products from which the Customer has withdrawn. The basic condition for the refund is the return of the Goods\/Products by the Customer. Refunds are made primarily by bank transfer to the bank account specified by the Customer. The Company will process the refund only after receiving the returned Goods\/Products.<\/li>\n<li>Return of Goods\/Products \u2013 the Customer is obliged to return the Goods\/Products without undue delay, no later than 14 days from the date of withdrawal from this agreement. The deadline is considered met if the Customer sends the Goods back before the expiry of the 14-day period. The Customer acknowledges that returned Goods\/Products must be undamaged \u2013 intact, unopened and sent in a manner that prevents damage in transit. If returned Goods\/Products are damaged due to the Customer&#8217;s breach of obligations, the Company has the right to claim compensation for the reduction in the value of the Goods\/Products and deduct this from the amount refunded.<\/li>\n<li>The costs associated with returning Goods\/Products are borne by the Customer.<\/li>\n<\/ol>\n<h3>Return and Exchange of Goods of Satisfactory Quality<\/h3>\n<ol>\n<li>In accordance with consumer protection law, goods of satisfactory quality in the following categories are not eligible for exchange or return: medicinal products; personal hygiene products; oral hygiene products; perfumery and cosmetic products. These categories of goods cannot be returned in the Czech Republic.<\/li>\n<li>Complaints about goods of unsatisfactory quality are accepted upon receipt of the goods only. Please carefully inspect your order in the presence of the courier, at a collection point or at a parcel locker. Check that the packaging is intact and that all ordered items are present.<\/li>\n<li>If, after unpacking the order, you have a complaint about the quality of the goods (you opened the packaging and found a manufacturing defect) or the order does not match what you ordered, please contact our team by phone at +420 607 416 929 and send a photo of the defective or damaged item clearly showing the defects via Telegram or by e-mail to xiaomoxuan.cz@gmail.com. Please also include your order number and a description of the defective item. We will replace the goods at our expense, unconditionally.<\/li>\n<li>We also offer the option to return or exchange received goods within 14 days of the order receipt date, provided that:\n<ul>\n<li>the contents of the parcel (quantity and type of products) do not correspond to what was agreed at the time of placing the order;<\/li>\n<li>the product has not been used after opening the packaging, and the appearance of the goods matches the original (original packaging retained, goods correspond to the item purchased from us);<\/li>\n<li>for an exchange or return, the goods must be returned undamaged, with no signs of use, in the original packaging.<\/li>\n<\/ul>\n<\/li>\n<li>Please wait for a message from our team by e-mail with further instructions.<\/li>\n<li>Once the parcel is returned to us, we will inspect it and within 14 business days either refund the payment to your account or dispatch new goods.<\/li>\n<\/ol>\n<h3>Return of Defective Goods or Goods of Unsatisfactory Quality<\/h3>\n<ol>\n<li>The Customer has the right to request replacement or return of goods of unsatisfactory quality.<\/li>\n<li>Complaints about goods of unsatisfactory quality are accepted upon receipt of the goods only. Please carefully inspect your order in the presence of the courier, at a collection point or at a parcel locker. Check that the packaging is intact and that all ordered items are present.<\/li>\n<\/ol>\n<p><strong>Goods of unsatisfactory quality<\/strong> are goods that contain defects. A product defect is a discrepancy with the declared characteristics. Delivered goods must correspond to the description on the website. Differences in design or visual appearance compared to the website description do not constitute a quality defect.<\/p>\n<h2>VII. ORDER PROCESSING PROCEDURE<\/h2>\n<ol>\n<li>Each order is processed by us in turn through one of the following channels: the website, social media, messaging apps or by phone.<\/li>\n<li>Orders are processed between 9:00 and 16:00. If you placed an order outside business hours or were unable to reach us, your order will be confirmed and processed on the next business day. Our Xiaomoxuan online store team will contact every customer without exception.<\/li>\n<li>Orders are accepted and processed within one business day (excluding weekends and public holidays).<\/li>\n<li>Online orders are accepted 24 hours a day.<\/li>\n<\/ol>\n<h2>VIII. SHIPPING AND DELIVERY<\/h2>\n<p>Orders placed and confirmed during Xiaomoxuan&#8217;s business hours before 14:00 are dispatched the same day. Orders placed after this time are dispatched to the recipient on the next business day.<\/p>\n<p>We offer three delivery methods: home delivery by courier or delivery to the nearest parcel locker.<\/p>\n<ul>\n<li>In the Czech Republic we ship via PPL.<\/li>\n<li>In Poland we ship via InPost.<\/li>\n<li>Delivery to Germany via PPL or Deutsche Post.<\/li>\n<li>Delivery to all other countries via PPL or Czech Post.<\/li>\n<\/ul>\n<h3>DELIVERY TIMES<\/h3>\n<ul>\n<li>Delivery to major cities in the Czech Republic and Poland: 1\u20133 days (in most cases).<\/li>\n<li>Delivery to smaller towns and villages: slightly longer \u2013 3\u20135 days (times depend on the carrier&#8217;s logistics).<\/li>\n<\/ul>\n<h3>DELIVERY COSTS TO THE CZECH REPUBLIC<\/h3>\n<p>Delivery in the Czech Republic via PPL is free for orders of 3 or more product units (approximately from 2,500 CZK). Delivery costs are charged according to the rates of PPL, DHL or Czech Post for the selected destination country. Orders of 3 or more products receive a 50% discount on delivery.<\/p>\n<ol>\n<li>Please note that deliveries to countries outside the EU may be subject to import duties and taxes levied by the destination country upon arrival. STORAGE RECOMMENDATIONS<\/h2>\n<p>Due to the nature of the Goods\/Products supplied by the Company, particularly cosmetic products, proper storage is essential.
